Magnitude Performance Institute (MPI) - Terms of Service
Agreement to Terms
By using the services or products of the Magnitude Performance Institute (MPI), you agree to follow these terms and conditions. MPI may update these terms without prior notice. Any new features added to the service will also be subject to these terms. If you continue to use the service after changes are made, it means you accept those changes.
Payments, Refunds, and Membership Changes
Payment for the service is due in advance for the term specified and is non-refundable. No refunds or credits are given for partial terms, changes in membership, credit balances, or unused time.
For upgrades or downgrades in membership, your card will be charged a prorated amount. The new rate will apply from your next billing cycle. All fees include GST.
Membership Suspension
You can suspend your membership for a minimum of 14 days, with a maximum of 90 days per year. To do so, email jess@sjpmedia.co with your desired suspension dates (Monday - Friday, 9am - 5pm) at least one week in advance. The suspension must be approved by MPI and cannot be backdated. A confirmation email will be sent once approved.
Membership Renewals and Payments
Memberships automatically renew unless you cancel by email. If payment is declined, you cannot train with MPI until payment is made.
Membership Cancellations
To cancel your membership, provide 30 days' notice via email.
Class Booking and Attendance
You must book classes at least 2 hours before the start time.
For morning classes, cancellations must be made at least 10 hours before the class starts.
For afternoon/evening classes, cancellations must be made at least 3 hours in advance.
Failing to cancel in time and not showing up will result in a warning. Repeated no-shows may limit your ability to book classes the following week, though full membership payment will still be required.
Access Tags
On sign up, you will need to pay a $25 deposit for an access tag. This deposit is returned to you when the tag is returned to the gym should you choose to discontinue your membership. Access tags give you access to the pedestrian gate, building door, and gym door. You will have access half an hour before the first class of the morning / evening, and half an hour after the last class of the morning / evening. Your tag will not provide access at other times.
Parking
There is no on-site parking. The carparks outside of the gym belong to the surrounding businesses. Please park on the road.
Injuries
By using MPI's facilities, located at 80 Tidal Road, Mangere, Auckland, 1021, owned by SupplyChain Solutions Ltd. and managed by SJP.media Ltd, you accept the risk of personal injury. MPI, its owners, and employees are not liable for any injuries, damages, or losses, including those due to negligence or theft.
If an injury prevents you from attending sessions for a week, we cannot credit missed sessions. If the injury causes more than a week's absence, a medical certificate is required, and arrangements can be made to put your membership on hold.
Refunds
Refund requests are handled at MPI's discretion. Requests must be made in writing via email to jess@sjpmedia.co. MPI will contact you to discuss the issue. If MPI is at fault, a refund will be issued and deposited into your account. Trainers are not authorised to issue refunds directly.
Damaged, Lost, or Stolen Property
MPI is not responsible for any personal property that is damaged, lost, or stolen while on its premises.
Response Time
MPI will respond to all emails, messages, calls, and social media posts within 48 hours.
Advertising and Publicity
MPI may photograph sessions for promotional purposes. If you do not want your image used, please inform MPI in writing.
Privacy Policy
MPI collects personal information from members but does not share or sell this information to other organisations for commercial purposes, except as necessary to provide services you’ve requested or with your permission.
Data Storage
MPI uses third-party vendors for hardware, software, networking, and storage. You retain all rights to your data.
Disclosure
MPI may disclose personal information in special circumstances, such as to comply with legal requirements or if your actions violate these terms.
Changes to Terms
MPI may update these terms periodically and will notify you of significant changes by email.
